Conservation Commission Minutes 2/22/11
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
INTERIM MEETING DATE: 2/22/11
Present: Richard Andrus, Timothy Lovett, David Dempsey, Christopher Blair and Betty Pixley
The meeting convened at 6:00p.m.

The Commission met to discuss an Enforcement Order issued to Louis & Claire Rigali of Harmon and Gould Rds for a landing created for a logging operation that was placed in a resource.  Present were Dennis Candelora of N.E. Timberland Investments LLC, Claire Rigali and Louis Rigali.  The Enforcement Order was issued on February 3rd.  The logging operation was primarily in New Marlborough but a portion of it is in Monterey.  The activity near the bridge on Tryon’s farm was not permitted within the context of the permit.  The logs there were all placed within a river zone and flood plain and no application was made to do that.  The Commission is happy that the ground is currently frozen but this meeting and Order was issued to make sure everyone knew what was expected going forward.  Dennis stated that the timber harvesting on this property has been complete now for a couple of weeks.  All trucking should be wrapped up by mid next week, Thursday (March 3) at the latest unless there is a thaw.

The Commission stated that the Rigali’s did everything correct and the Commission should speak with Roger Tryon since the violation was actually performed on his land.

The Commission has requested that:
  • have a fuel spill kit on site at the logging yard
  • give us a contact name/phone for someone supervising the work
  • have the work here concluded by a date certain- this work may not continue after any soil is visible, this work may not continue after the ground thaws.
  • Communicate with Monterey Conservation Commission and with Thomas Ryan, Service Forester to develop an immediate response to this Enforcement Order
  • Call Chris Blair when they are done.  Dennis will keep in touch with Chris.
For Discussion:
1.  Mail was reviewed.
2.  Minutes from 1/11/11 and 2/8/11 were approved as written.
3.  Betty noted that the project that was approved at the February 8th meeting for 48 Tyringham Rd. burned their brush in the lakebed.  The applicant was given permission to burn but not in that area.  Betty is going to call John Fields and let him know it shouldn’t have been burned there and he needs to clean it up.  Betty will be asked to be notified when the clean up is complete so she can make a site visit.
